Terms and Conditions

• Photographer means a professional or amateur who uploads photos to the Site for review by a client.
• Client means an individual or entity who hires a photographer to capture photographs of an event, occasion, or session.
• Content means any photos, images, text, or other material uploaded or shared on the Site.
• Final Photos means the photographs delivered by the photographer to the client once the selection and editing process is complete and payment has been made.

Pick the Pic provides an online service that facilitates:

• Uploading of photos by photographers for client review.
• Client review, commenting, and selection of photos.
• Streamlined communication and collaboration between photographers and clients.

We are not a party to any agreement between photographers and clients, and we do not guarantee the quality, timeliness, or delivery of services.

• To use certain features, you must create an account.
• You agree to provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your login credentials and all activities conducted under your account.
• We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

• Client Ownership: Unless otherwise agreed in a separate written contract, photographs taken by photographers at the direction of a client are considered works made for hire and are owned by the client once the photographer has been paid in full.
• Photographer's Limited Rights: Until payment is made, the photographer retains temporary rights to the photos and may use watermarked versions for client review.
• No Unauthorized Use: Clients may not reproduce or distribute photos prior to final delivery unless expressly permitted by the photographer. Likewise, photographers may not use client-owned photos for marketing, portfolio, or other purposes without the client's written consent.

• Photographers grant clients a limited, temporary license to view and select photos on the Site for the purpose of approving final selections.
• Clients may not share or distribute selection photos outside the platform until ownership has transferred.
• You agree not to use the Site for any unlawful purpose or in a manner that infringes on the rights of others.

• Pick the Pic may offer premium features, such as enhanced storage, collaboration tools, or subscription plans.
• Photographers and clients are responsible for separately agreeing on payment terms for photography services.
• Pick the Pic is not responsible for enforcing or processing payments between photographers and clients, unless explicitly offered through a platform-integrated payment system.

• Use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and safeguard personal data.
• Photographers and clients agree not to upload sensitive personal data beyond what is necessary for photo sharing and selection.
• We may remove content that violates privacy, intellectual property, or data protection laws.

• Pick the Pic is a facilitator, not a party to photographer-client agreements.
• We do not verify the identity, qualifications, or reliability of photographers or clients.
• We do not guarantee that photos uploaded to the Site will be permanently stored. Photographers and clients should maintain independent backups.
• The Site is provided “as is,” without any warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by law:

• Pick the Pic and its affiliates shall not be liable for any indirect, incidental, or consequential damages, including lost profits, lost data, or disputes between photographers and clients.
• Our total liability for any claim related to your use of the Site shall not exceed the amount paid by you (if any) to use our services in the twelve (12) months preceding the claim.

Users may not:

• Upload unlawful, defamatory, obscene, or infringing content.
• Use the Site to harass, threaten, or abuse others.
• Attempt to hack, disrupt, or gain unauthorized access to the Site.
• Reproduce, distribute, or exploit photos contrary to the agreed ownership terms.

Violations may result in account suspension or permanent termination.

• Any disputes regarding payment, ownership, or use of photos must be resolved directly between the photographer and client.
• Pick the Pic may, at its sole discretion, assist in resolving disputes but has no obligation to do so.

You agree to indemnify, defend, and hold harmless Pick the Pic, its owners, employees, and affiliates from and against any claims, damages, or expenses arising out of:

• Your use of the Site;
• Your violation of these Terms; or
• Disputes relating to photo ownership or service agreements.

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts located in Goa, India.

We may revise these Terms at any time. Updated versions will be posted on the Site, and your continued use after changes constitutes acceptance.
