Terms and Conditions

• Photographer: A user who uploads, shares, or manages photos and shoots on the platform.
• Client: A user invited by a photographer to view, comment on, or select photos.
• Content: All media, photos, metadata, and associated data uploaded or generated within PickThePic.
• Preview Image: A lower-resolution (e.g., 2K) version of the original photo automatically generated for faster display.
• Original Image: The full-resolution image stored in the photographer’s connected storage (e.g., Google Drive).
• Selected Photos: Photos chosen by the client for final delivery or editing.
• Active Shoot: A single project or gallery shared by a photographer with one or more clients.

• PickThePic facilitates uploading, previewing, commenting, and selection of photos between photographers and clients.
• Photographers can organize shoots, manage client access, and generate secure sharing links with expiry dates or access codes.
• Clients can review, select, and download photos through shared links.
• The platform automatically processes uploaded photos to generate optimized previews for better user experience.

We are not responsible for the contractual relationship between photographers and clients, including payment terms, delivery, or quality of work.

• Uploaded photos are stored securely using third-party cloud services such as Supabase, Google Drive, or Dropbox, depending on the photographer’s chosen storage mode for each shoot.
• Original full-resolution images live in the linked Google Drive or Dropbox account when those modes are selected. When Supabase-only mode is used, we store resized 2K previews. For Drive/Dropbox shoots, we store 2K previews and thumbnails in Supabase for faster loading; originals stay in your cloud storage.
• PickThePic staff may access uploaded images solely for troubleshooting, content moderation, or verification purposes. We do not share or sell any content to third parties.
• Shoots auto-expire based on your plan’s validity window (Free 15 days, Plus 30 days, Pro 60 days) with a 2-day grace before archival. You may buy an extension add-on to add +30 days and set a new deadline within that window.
• When a shoot is fulfilled or reaches its expiry + grace window, it may be archived and removed from active dashboards. Archiving deletes Supabase-hosted previews/thumbnails, keeps selection data, and preserves Drive/Dropbox originals in your own storage. Once archived and deleted from Supabase storage, previews cannot be restored.

• Free and paid subscription tiers define usage limits such as the number of active shoots, photo uploads, and storage space.
• Exceeding plan limits may require upgrading your account or purchasing additional storage or shoots.
• Deadlines you set for a shoot must fall within the plan’s active window (see validity above); leaving the deadline blank defaults to the maximum allowed date for your plan.
• Subscription fees are non-refundable once billed, except where required by law.
• PickThePic reserves the right to change pricing or feature limits with prior notice.

• Client access links generated by photographers may have expiry dates or be limited to specific users.
• Once a link expires, access to the gallery will be restricted or deleted for data protection and storage optimization.
• PickThePic is not responsible for loss of access due to expired or deleted links.
• When storage is Google Drive or Dropbox, download links open the respective folder in your connected account; Supabase-only shoots provide downloads from PickThePic-hosted previews.

• To enhance performance, the platform may automatically generate resized or optimized versions (e.g., 2K previews or thumbnails) using automated scripts or AI-based compression.
• These previews are for display only; the original image remains unchanged and accessible by the photographer.
• PickThePic does not use uploaded images for model training, public AI datasets, or marketing without explicit written consent.

• Photographers retain full rights to their photos until ownership transfers to the client through a separate agreement.
• Clients may only use delivered final photos for agreed purposes.
• You grant PickThePic a limited, non-exclusive license to host, process, and display uploaded content solely for providing our service.

• We reserve the right to remove or restrict any content that violates these Terms, privacy laws, or copyright rules.
• Our support or moderation team may temporarily access user content for troubleshooting or compliance checks.
• All access is logged and restricted to authorized personnel only.

• You may delete your account at any time. Upon deletion, all data and images may be permanently removed within 30 days.
• We may suspend or terminate accounts that abuse storage limits, upload illegal content, or violate our Terms or Privacy Policy.

• PickThePic is not liable for data loss, unauthorized access, or downtime caused by third-party providers or user error.
• Our total liability shall not exceed the subscription fees paid in the preceding twelve (12) months.

We may update, enhance, or discontinue features to improve performance or security. Continued use after such updates constitutes acceptance of the modified terms.

These Terms are governed by the laws of India. Any disputes shall be handled in the courts of Goa, India.
